1. Acceptance of these terms
By accessing or using the House of Icon website, you agree to these Terms & Conditions and to our Privacy Policy. If you don't agree with them, please don't use the site.
You must be at least 18 years old, or the age of majority where you live, to use this site or engage our services.
2. Who we are
House of Icon is a Creative House founded and operated by Brea Ballard in the United States, offering brand strategy, visual identity, packaging design, content, and Brand Camp programs for entrepreneurs. In these terms, "we," "us," and "our" mean House of Icon; "you" means the person or business using this site.
3. Using this website
You're welcome to browse, read, and share this site. You agree not to:
- Use the site for any unlawful purpose or in violation of any applicable law
- Copy, scrape, mirror, or systematically extract content from the site
- Attempt to gain unauthorized access to any part of the site or its systems
- Introduce malware, viruses, or any harmful code
- Interfere with the site's operation, security, or availability
- Use automated tools to harvest email addresses or other information
- Misrepresent your identity or affiliation when contacting us
We may suspend or block access to anyone who breaches these terms.
4. Intellectual property
All content on this site — including the House of Icon name, logo, the asterisk mark, written copy, layout, design, graphics, photography, and code — is owned by House of Icon or used with permission, and is protected by copyright, trademark, and other intellectual property laws.
You may view the site and print or download individual pages for your own non-commercial reference. You may not reproduce, republish, distribute, modify, or create derivative works from any part of it without our prior written permission.
Nothing on this site grants you a license to use any House of Icon trademark or the trademarks of any client featured here.
5. Portfolio & client work
Work shown in the Wall of Icons is displayed to illustrate our capabilities. All client brands, logos, product names, and imagery remain the property of their respective owners and appear here with permission or as permitted by our agreements.
Portfolio pieces reflect completed or representative projects. They are examples of our approach, not a promise of any particular outcome for your brand.
6. Inquiries are not a contract
Submitting a form, sending an email, or having an initial conversation with us does not create a binding agreement or a client relationship. We are not obligated to accept any project.
A client relationship begins only when both parties sign a written agreement, proposal, or statement of work. That signed document governs the specific engagement, and where it conflicts with these terms, the signed document controls.
7. Services, quotes & payment
Quotes, estimates, and proposals are valid for 30 days unless stated otherwise and may be revised if the scope of work changes.
- Scope. Deliverables, timelines, revision rounds, and fees are defined in your signed agreement.
- Deposits. Projects typically require a deposit before work begins. Deposits are non-refundable once work has started.
- Payment terms. Invoices are due as specified in your agreement. Late payments may pause work and may accrue interest where permitted by law.
- Ownership of deliverables. Final ownership of project deliverables transfers to you upon full payment, as set out in your agreement. Until then, we retain all rights.
- Our tools. We retain ownership of our underlying processes, templates, working files, and know-how, and of any concepts you did not select.
- Client materials. You confirm you have the right to any content, fonts, images, or trademarks you provide to us, and that our use of them will not infringe anyone's rights.
8. Brand Camp
Brand Camp is an educational program for entrepreneurs. Enrollment terms, schedules, pricing, and refund policies are set out at the time of registration.
Brand Camp materials are licensed to you for your own personal and business use. You may not record, resell, redistribute, or teach the materials as your own. Brand Camp provides education and guidance; it is not a guarantee of business results, revenue, or growth.
9. Third-party links
This site may link to third-party websites, including social platforms and client sites. We don't control those sites and aren't responsible for their content, accuracy, security, or privacy practices. Following an external link is at your own risk, and their terms apply once you leave our site.
10. Disclaimers
This website and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We work to keep the site accurate and available, but we don't warrant that it will be uninterrupted, error-free, secure, or free of harmful components. Content is for general information and is not professional, legal, or financial advice.
Some jurisdictions do not allow the exclusion of certain warranties. Where that's the case, the exclusions above apply only to the extent permitted by law, and nothing in these terms limits your non-excludable statutory rights — including, for Australian consumers, rights under the Australian Consumer Law.
11. Limitation of liability
To the fullest extent permitted by law, House of Icon and Brea Ballard will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising from your use of this site.
Our total aggregate liability arising from or relating to this website will not exceed one hundred US dollars (US$100). Liability arising from a signed client engagement is governed by the limitation set out in that agreement.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
12. Indemnification
You agree to indemnify and hold harmless House of Icon, Brea Ballard, and anyone acting on our behalf from any claims, damages, losses, liabilities, and reasonable legal fees arising out of your use of the site, your breach of these terms, or your violation of any law or third-party right.
13. Privacy & accessibility
How we handle your information is described in our Privacy Policy, which forms part of these terms.
We are committed to making this site usable by everyone. Our Accessibility Statement explains the standards we work to and how to tell us if you hit a barrier.
14. Governing law & disputes
These terms are governed by the laws of the United States and the state in which House of Icon is established, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located there, and you consent to that jurisdiction.
If you are a consumer resident in the UK, EU, Canada, or Australia, this does not deprive you of the protection of mandatory consumer laws in your country of residence, or of your right to bring proceedings in your local courts.
Before filing anything formal, we'd ask you to contact us first. Most things are solvable with a conversation.
Severability & waiver
If any provision of these terms is found unenforceable, the rest remain in full effect. Our failure to enforce a provision isn't a waiver of our right to do so later.
15. Changes to these terms
We may update these terms from time to time. The "last updated" date at the top of this page will always reflect the current version. Continuing to use the site after changes are posted means you accept them.
